More than 44 million Americans collect some kind of Social
Security benefit! Social Security in America is a system that is
available to all its citizens. The basic structure is that when you
work, you pay into the system. After you've paid into the system,
when you retire or become disabled, you and your family can receive
monthly benefits.
Those eligible for benefits: those who are retiring, disabled,
dependent upon someone who receives Social Security income, and
widows, widowers, or children of someone who has died. However, in
order to receive benefits there are requirements that must be met.
Disabled Widow's and Widower's Benefits are paid to those who are at
least 50 years old and become disabled within a certain amount of
time after the death of their husband or wife who has worked under
Social Security. Disabled Adult Child Benefits go to the children
(disabled before age 22) of persons who are deceased or who are
drawing Social Security disability or retirement benefits. An
earning record from the SSA determines benefit amounts.
To qualify for Social Security disability benefits, you must have "a
physical or mental impairment that is expected to keep you from
doing any substantial work for at least a year" or a condition that
is expected to result in your death.
A claim should be filed immediately, however, in most cases the
monthly benefits do not begin until after the sixth full month of
your disability.
Social Security disability benefits may be reduced if you are
getting workers' compensation or other government disability
benefits. The rule is that all the disability payments that you
receive may not exceed 80% of your average earnings before the
disability.
Social Security disability benefits normally will continue unless
your disability improves or you return to your regular work. Be
aware that your case will be reviewed periodically and the frequency
of such reviews is dependent on the medical improvement that is
expected by your treating physicians. Generally, if medical
improvement is expected, your case will be reviewed no sooner than
three years. If medical improvement is not expected, your case will
likely not be reviewed any sooner than seven years.
Factors considered when reviewing a disability claim are: whether
you have worked long enough and recently enough to be eligible, your
age, and relationship to the worker (if you are applying as a family
member). If your initial application is approved, it is then sent to
the Disability Determination Services (DDS) office in your state.
This office will make the decision as to whether you are disabled
under the Social Security laws. DDS will use the medical information
from any doctors, hospitals, clinics, or other providers where you
have been treated. They will be asked: what your condition is, when
it began, if it is limiting and to what extent, results of any
medical tests, and what treatment you have received. Additionally,
they will be asked about your ability to do general work-related
activities, such as walking, sitting, lifting, and carrying.
Additional medical information may be needed before the DDS can
decide your case. Social Security will pay for examinations and any
other additional medical tests they may need to make their decision.
Once a decision on your claim is reached, you will receive a written
notice from the Social Security Administration. If your claim is
approved, the notice will show the amount of your benefit and when
payments start. If it is not approved, the notice will explain why.
To determine disability, there are 5 questions that the DDS office
asks:
- Is the applicant working? If you are and your earnings average
more than $500 a month, you generally will not be considered
disabled.
- Is the condition severe? Severe is considered a disability
that interferes with general work-related activities.
- Is the disability found on their list of disabling
impairments?
- Is the applicant able to perform the work that he did
previously?
- Can the applicant do another type of work? (Age, education,
and work experience are considered in this section.)
Often times, a claim is denied and the applicant does not understand
why or what to do about it. Only one quarter of all first time
claims are approved by the Social Security Administration. SSA
approves more than half of all claims brought to court by an
attorney. You should contact an attorney if your claim has been
denied.
When applying for Social Security disability benefits:
- Be as brief as possible in your answers
- Answer honestly
- Organize all of your medical records and bring them with you (if applying in person)
